Terms and Conditions

These terms apply when you use nestyboxes.com.au or buy from us. Please read section 5 in particular. It sets out rights you have that we cannot take away, and it overrides everything else in this document.

1. About these terms

1.1 By using our website or placing an order, you agree to these terms.

1.2 These terms, together with our Privacy Policy, form the whole agreement between us.

1.3 We may update these terms. Where a change materially affects your rights, we will email customers holding an active account or subscription at least 14 days before it takes effect. Changes never apply retrospectively to orders already placed or to subscription orders already charged.

1.4 You must be 18 or older to buy from us, or have a parent or guardian purchase on your behalf.

1.5 Using the site properly

Please don't use our website to break the law, submit false information, upload malicious code, harvest other people's details, spam or phish, interfere with security, or harass or abuse anyone. Don't copy, resell or exploit our content, product images or descriptions without our written consent. We may suspend or withdraw access where any of this happens.

2. Products and pricing

2.1 All prices are in Australian dollars and include GST.

2.2 We describe and photograph our products as accurately as we can. Screen calibration varies, so colours may not appear identical on your device.

2.3 We may change prices at any time. If the price changes after you have placed an order, the price you paid at checkout stands.

2.4 If a genuine error results in a product being listed at an obviously incorrect price, we may cancel the order and refund you in full. We will contact you and explain what happened.

2.5 Stock availability is not guaranteed. Where we cannot supply an item you have ordered, we will contact you and refund that item in full.

2.6 Discount codes and promotions

Unless we say otherwise, discount codes apply to full price items only, cannot be combined with other codes or store credit, cannot be applied to an order already placed, and are limited to one code per order. Promotional codes may exclude sale items, bundles and subscription products, and we may withdraw a code at any time before it is used. Where a code has a stated expiry, minimum spend or usage limit, those terms apply.

3. Orders

3.1 Your order is an offer to purchase. A contract is formed when we send you a dispatch confirmation.

3.2 We may decline an order where we cannot supply the stock, where we reasonably suspect fraud, or where a retail account is being used for wholesale quantities. If we decline, we refund you in full and tell you why.

3.3 Cancelling before dispatch

Email us as soon as possible. Most orders leave our warehouse within 24 hours, so we cannot always intercept one. If we can, cancellation is free. If we cannot, section 6 applies.

3.4 Cancelling after dispatch

Section 6 applies.

4. Delivery

4.1 We deliver within Australia only.

4.2 Delivery charges

  • Chicken feed, seed and small animal food: $9.95 flat
  • Nest boxes and incubators: $29.95 flat
  • Express: calculated at checkout

4.3 Rural and remote addresses

Some addresses attract an additional charge. Where one applies, we will contact you before dispatch. You may approve the additional charge or cancel the order for a full refund. We will not charge you more than the quoted price without your agreement.

4.4 Delivery times

Dispatch and transit estimates are published on our Delivery page. Transit times are the carrier's estimates, count from dispatch rather than from order, and are business days. During spring hatching season, Black Friday and December, dispatch may take an additional business day.

4.5 Who carries the risk

Risk in the goods remains with us until they are delivered to the address you nominated. If your order is lost or damaged in transit, contact us. You do not need to deal with the carrier yourself.

4.6 Transit damage or a missing item

Please tell us within 7 days of delivery. Our carriers impose claim deadlines on us, which is the only reason this deadline exists. It does not limit your rights under section 5, and if you miss it you should still contact us.

4.7 Authority To Leave

If you select ATL at checkout you are instructing the carrier to leave the parcel unattended. We will still assist you in tracing a missing parcel, but where a carrier confirms delivery to your nominated address under an ATL instruction, recovery may not be possible.

4.8 Incorrect addresses

If the address you supply is incomplete or incorrect and the parcel is returned to us, we will refund the order less the actual return freight charged to us, or you may pay the redelivery cost. We pass on the carrier's charge without a margin.

4.9 PO Boxes

Feed, seed and small accessories can be delivered to a PO Box. Nest boxes, incubators and other bulky items cannot.

5. Your consumer rights, which override all others

5.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

5.2 Nothing in these terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. If any part of these terms would do so, that part does not apply.

5.3 Major failures, where you choose the remedy

Where a failure is major, you choose whether you want a refund or a replacement. We do not choose for you. A failure is major where, for example, the goods are unsafe, are significantly different from their description, cannot be fixed easily or within a reasonable time, or where you would not have bought them had you known.

5.4 Minor failures

Where a failure is minor, we may repair, replace or refund. We will tell you which and why, and we will do it within a reasonable time.

5.5 There is no deadline on raising a fault

The consumer guarantees apply for as long as is reasonable given the nature of the product, its price and how long it could reasonably be expected to last. A bag of feed and a $399 incubator are held to very different standards. Please tell us as soon as you reasonably can after you become aware of a problem.

5.6 We pay the freight

Where goods are faulty, damaged, incorrectly supplied or not as described, we cover the cost of returning them and will provide a prepaid label. For bulky items we will arrange collection rather than asking you to post them. In remote areas where collection is unavailable, contact us and we will agree the method before you send anything. You will not be out of pocket on a faulty item.

5.7 No fees apply

We do not charge restocking, handling or administration fees on any claim under this section.

5.8 How to make a claim

Email sales@nestyboxes.com.au with your order number, a description of the problem, and photographs or a short video where the problem is visible. We respond within 1 business day. Photographs often allow us to resolve a claim without you returning anything.

5.9 How long we take

Where we ask for goods back, we assess them within 3 business days of arrival. Approved refunds are processed within 3 business days and appear in your account within 5 to 10 business days depending on your financial institution.

6. Change of mind returns

This section is separate from section 5 and applies only where there is nothing wrong with the goods. We are not required to accept change of mind returns. We do, on the conditions below.

6.1 The window

30 days from delivery.

6.2 Get authorisation first

Do not send anything back before we have approved it. Email sales@nestyboxes.com.au with your order number and reason. We will respond within 1 business day with an authorisation and a return address. Unauthorised returns may be refused or returned to you at your cost.

6.3 Condition of returned goods

To be accepted, goods must be:

  1. unused and unopened, with all seals intact;
  2. in their original, undamaged packaging with all tags, manuals, fittings and accessories;
  3. accompanied by a copy of your invoice;
  4. in a condition we can lawfully resell.

6.4 Biosecurity

Equipment must not have been in contact with birds, or placed inside a coop, run, aviary or brooder.

This is not fussiness about appearance. Equipment used in a flock environment can carry mites, lice and disease organisms, and we will not resell it to another keeper. If it has been in with your birds we cannot accept it back for change of mind.

If the item is faulty, this does not apply. Section 5 does, and the answer is yes.

6.5 What we cannot accept back on change of mind

  1. feed, treats, supplements and mash once opened;
  2. registered veterinary chemical products and animal medicines, once dispatched, for safety and traceability reasons;
  3. seed and live plant products once opened;
  4. items assembled, installed, modified or used;
  5. gift cards;
  6. custom, clearance and bulk orders (more than one incubator, or three or more units of any other item);
  7. anything that has been in contact with birds (see 6.4).

If there is something wrong with any of these, section 5 applies as normal.

6.6 Your remedy

Our standard remedy is store credit to the value of the goods, valid for 12 months. We may issue a refund to your original payment method instead, at our discretion.

6.7 Return freight is yours

You arrange and pay for return delivery on change of mind returns, and you bear the risk until the goods reach us. We recommend a tracked service. Original delivery charges are not refunded.

6.8 Restocking fee

A 10% restocking fee applies to hardware returned under this section, deducted from your credit or refund. It is waived where you choose an exchange or accept store credit for the full value. No restocking fee applies to anything under section 5.

6.9 Reduced value

Where goods arrive back damaged, incomplete, or without their original packaging, we may reduce the credit or refund to reflect the loss in value. We will tell you the amount and why before we process it.

6.10 Timing

Once authorised, goods must reach us within 14 days. We assess within 3 business days of arrival and issue credit or refund within 3 business days of approval.

7. Subscriptions

7.1 How it works

Subscribe and save 10% on selected products, delivered automatically on the cycle you choose: every month, every 2 months, every 3 months or every 4 months.

7.2 What you pay

10% off the standard price of the subscribed product on every order, for as long as the subscription runs. Delivery is charged at the standard rate for each delivery. The discount applies to the subscribed product only and does not combine with other promotional codes unless we say otherwise.

7.3 When we charge

We charge the payment method held on your account on the day each order is processed.

7.4 Advance notice

We email you 3 days before every charge, showing the amount, the products and the date, so you always have time to skip, change or cancel before payment is taken.

7.5 Managing your subscription

Log in at nestyboxes.com.au and use Manage Subscription, or email us. You can:

  1. skip the next delivery;
  2. change the frequency;
  3. change the quantity, size or product;
  4. change the delivery address or payment method;
  5. pause for up to 3 months.

Changes made at least 3 days before a scheduled charge apply to that order. Later changes apply to the following order.

7.6 Cancelling

You may cancel at any time, from your account or by emailing us. There is no cancellation fee, no minimum term and no notice period. We will not ask you to justify the decision.

Cancelling at least 3 days before a scheduled charge stops that order. If an order has already been processed it will be dispatched, and section 6 applies to it.

7.7 Failed payments

We retry after 3 days and again after 7, emailing you each time. If payment has not succeeded after the third attempt we pause the subscription rather than cancelling it, so your discount is preserved. Updating your payment details resumes it.

7.8 Price changes

If we change the price of a subscribed product we email you at least 14 days before it takes effect. Your discount continues to apply to the new price. You may cancel before the change without penalty.

7.9 Out of stock

If a subscribed product is unavailable we email you, skip that delivery and do not charge you for it. The subscription remains active and resumes on the next cycle.

7.10 Your rights are unchanged

Sections 5 and 6 apply to subscription orders exactly as they apply to single orders.

8. Warranty

8.1 The warranty below is given in addition to your rights under section 5. It does not replace, limit or reduce them, and where the two differ, whichever gives you more applies.

8.2 Warranty periods

From the date of delivery:

  • Chicken coops: 10 years, from the date they go on sale
  • All other hardware: 12 months

That covers rollaway nest boxes, incubators, brooder heat plates, automatic coop doors, the automatic rat trap, feeders, drinkers, Chicknic Tables and accessories. Full detail is on our Warranty page.

Feed, seed, supplements and consumables are not covered by a fixed term warranty because they are consumed. They are covered by section 5. If a product arrives mouldy, contaminated, out of date or not as described, contact us.

8.3 What it covers

That the product matches its description and specifications, is free from defects in materials and workmanship, and functions as intended.

8.4 Incubators and heat plates

If an incubator or brooder heat plate fails during an active hatch or brood, contact us immediately rather than waiting for the cycle to finish. We treat these as urgent and, where the failure is ours, we will replace the unit rather than repair it.

8.5 What it does not cover

Normal wear and tear; incorrect assembly or failure to follow instructions; weather, predator or animal damage; repairs or modifications not authorised by us; misuse, accident, impact or fire; and consumable parts within a mechanical product.

8.6 Making a warranty claim

Email sales@nestyboxes.com.au with your order number, a description of the fault and supporting photographs or video. Where a replacement part will resolve it we send the part and instructions at our cost. Otherwise we arrange return or collection at our cost and repair, replace or refund. You do not pay freight on a warranty claim.

9. Product safety and animal health

9.1 We are not veterinarians

Nothing on our website, in our emails or in our guides is veterinary advice or a diagnosis. If a bird is unwell, consult a veterinarian.

9.2 Feed and supplements

Our feed products are formulated for poultry and are not for human consumption. Feed as directed. Supplements and treats are supplementary and are not complete feeds. Where a product states a maximum inclusion rate or maximum proportion of the diet, observe it. Always provide fresh, clean water.

9.3 Registered veterinary chemical products

Always read the label and the approved directions before use. Use only at the stated rate and for the stated species. Observe all withholding periods. Some products carry a withholding period for eggs, meat or both, stated on the label and on the product page. Observing them is your responsibility if you consume eggs or meat from treated birds. Keep out of reach of children.

9.4 Electrical products

Read the instructions before first use. Use only the supplied power supply. Do not use a unit with damaged cabling. Stop and contact us. Protect equipment rated for indoor use from the weather. Keep bedding from building up around heat plates and check them daily during use.

9.5 Hatching outcomes

Hatch rates depend on egg fertility, storage, handling, breed, ambient conditions and operator technique, most of which are outside our control. Our incubators are warranted to function as described. They are not warranted to produce chicks. We recommend running a new incubator empty for 24 hours before setting eggs.

9.6 Coops and hardware

Assemble as instructed and check fixings periodically, particularly after storms. These products assist in protecting birds. No coop is proof against every predator.

9.7 If several birds fall ill

If a number of birds become sick or die suddenly, contact your veterinarian or the Emergency Animal Disease Watch Hotline on 1800 675 888.

10. Our liability

10.1 This section is subject entirely to section 5.

10.2 Where we are permitted by law to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of any of those things.

10.3 We are not liable for loss that is not reasonably foreseeable, or for loss arising from your failure to follow instructions, storage requirements, dosage directions, withholding periods or safety warnings.

10.4 Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited by law.

11. Content and intellectual property

11.1 Photos and reviews you send us

If you send us photographs, reviews, competition entries or similar, you grant us permission to use them in our marketing, together with your first name and general location. Tell us at any time if you would prefer we stopped and we will. You retain ownership.

Only send us material you have the right to share. We may decline or remove content that is unlawful, offensive, misleading or infringes someone's rights.

11.2 Our content

The Nesty name, logo, product photography, packaging, guides and website content belong to us. You're welcome to share our content on social media with credit. Please don't reproduce it commercially, or use it to sell competing products, without asking us first.

11.3 Links to other websites

We sometimes link to third party sites, suppliers and information sources. We don't control them and we're not responsible for their content, products or practices. Their terms and privacy policies apply, not ours.

12. Privacy

12.1 How we collect, use, store and disclose personal information is set out in our Privacy Policy.

12.2 We do not sell personal information.

12.3 Marketing emails and SMS are sent only with your consent and every message carries a working unsubscribe.

13. If something goes wrong between us

13.1 Contact us first at sales@nestyboxes.com.au. Most matters are resolved within a week.

13.2 If we cannot resolve it, you may contact Consumer and Business Services South Australia, your own state or territory consumer protection agency, or the ACCC. We will participate in any reasonable dispute resolution process.

14. General

14.1 These terms are governed by the laws of South Australia and you and we submit to the jurisdiction of its courts on a non exclusive basis.

14.2 If any provision is found to be unenforceable, it is severed and the remainder continues to apply.

14.3 A failure by us to enforce a provision is not a waiver of it.

14.4 Events outside our control

We are not liable for failure or delay caused by events beyond our reasonable control, including natural disaster, disease outbreak, industrial action, carrier failure and utility or network outage. We will tell you and, where we cannot perform within a reasonable time, refund you.

14.5 Ending the arrangement

You may stop using our website at any time. We may suspend or close an account where clause 1.5 is breached, or where we reasonably suspect fraud. Doing so does not affect orders already dispatched, refunds already owed to you, your rights under section 5, or any amount owing to us. Sections 5, 10, 11 and 14 continue to apply afterwards.
